Cancellation & Refunds
1. Cancellation and Refund Policy:
1.1. BRAINYLY.COM provides software services through its Website, Web-applications and Mobile-applications. These services are subscription based. BRAINYLY.COM does not sell or ship any articles or products.
1.2. Therefore, all sales are final and no refunds will be issued for partially used subscription periods. Exceptions may be made in specific circumstances, such as proven fraud or guarantees offered by some platforms.
2. Cancellation Policy:
2.1. User’s Right to Cancel:
Users can typically cancel their subscription at any time. The cancellation usually takes effect at the end of the current billing cycle.
2.2. No Pro-rated Refunds: Cancelling a subscription does not usually entitle the user to a pro-rated refund for any unused time. The user can continue to use the premium features until the end of the paid-for period.
2.3. Auto-Renewal: As a policy, BRAINYLY.COM does not implement auto-renewal feature. Therefore, users must renew their services and subscription actively at the end of their subscription period.
2.4. If a user does not comply and follow the Terms and Conditions of usage and the Privacy Policy, his/her profile, posts, services might get blocked. This can happen even when the user has one or more active subscriptions. User will not be refunded for the number of days his/her profile, posts, services are blocked.
3. Refund Policy:
3.1. Generally Non-Refundable: For the above mentioned reasons, all subscription fees are non-refundable once payment is processed.
3.2. Specific Exceptions: Refunds may be considered under certain conditions:
Fraudulent Activity: If it is proven that a user’s card was used fraudulently on the website, a refund will be issued.
Erroneous Purchases: A one-time refund may be granted for accidental purchases, provided the purchased credits or services remain unused.
Performance Guarantees: Some platforms offer a guarantee (e.g., a full refund if no meaningful responses are received within 30 days) subject to specific conditions.
Termination by Platform (Without Cause): If the platform terminates a user’s membership without a violation of its terms, the user may receive a pro-rata refund for unused fees.
Legal Requirements: Specific jurisdictions (e.g., California subscribers have a three-day cancellation right) may have laws mandating specific refund windows.
Third-Party Purchases: For subscriptions purchased through the Apple App Store or Google Play Store, refund requests must be directed to Apple or Google, respectively, as they manage the billing.
Process: To request a refund, users generally need to contact customer support with their account and transaction details. Requests are reviewed on a case-by-case basis.
